Industrial Relations Bill EXPLANATORY AND FINANCIAL MEMORANDUM The purpose of the Bill is to amend the law relating to employers and workers and to organisations of employers arc organisations of workers. The Bill also provides for the establishment of a National Industrial Relations Court and for extending the jurisdictica of Industrial Tribunals. There is provision for the appoin ment of a Chief Registrar of Trace Unions and Employers Associations and for establishing a Commission on Industrial Relations as a statutory body. PART I-INTRODUCTORY Clause 1 states general principles for the promotion of good industrial relations and lies the individuals and institutions who shall have regard to ther. Cleuse 2 requires the Secresary of State to prepare a Code of Practice giving practical guidance on the application of these principles, and Clause 3 provides for Parliamentary aproval of the Code and of subsequent indicates its status in proceedings befor amendments; Clease the National Incustrial Relations Court (hereafter called the Industrial Court) and Industrial Tribunals. PART II-RIGHTS OF WORKERS Clause 5 gives to every worker the right to belong to an independent trade union, to take part in its activities, and to seek office in that un en It also gives the worker the righ not to belong to an independent trade union or other organisation of workers. Any action by an employer which discriminates against the worker for exercising or seeking to exercise these rights will be an unfaindustrial practice except when there is an agency shop agrement covering the worker’s employment and the worker refuses ether to join the union or to pay an appropriate contributica o its funds or to charity. Clause 5. Clause 6 makes it as unfair industrial practice to induce or attempt to induce an employer to infringe a worker’s rights ander Clause 7 makes void ary provision in an agreement which purports to prevent the engagement of an employee who is not a member of a trade anion or other organisation of werkers or whose engagement has not been recommended or approved by a trade union or other organisation of workers.
